課程概述 |
社會運動不能忽視法律。運動者可能選擇刻意選擇以佔領工廠或政府機關、阻礙交通的違法公民不服從行動來從事抗爭;也可能以申請合法集會遊行的方式來提出訴求創造壓力。前者背負了法律風險,後者則使用法律。運動者可能因為法律風險的實現(被起訴)而「被迫」進行法律動員,也可能以主動提出訴訟控告侵權者、或進行立法遊說的方式主動進行法律動員。運動訴求的產生可能是因為某個法律積極造成的壓迫,也可能是因為法律束手旁觀某些壓迫。然而,訴諸法律進行社會運動的恆久難題是:法律有用嗎?法律是否有助於促進社會改革?
法律不能忽視社會運動。將社會運動訴求制度化的方式之一,就是以法律主張提出訴求,透過訴訟或立法遊說讓社會運動的訴求成為法律或判決的內容。法院可能是社會運動的場域:訴追運動者、審判運動訴求,或者憲法法院審查法律合憲性。追求進步價值的社會運動者可能透過訴訟來達成促進進步價值的運動目標,保守法律運動(conservative movement)同樣可能以訴訟抵制或摧毀進步價值的成果。立法機關也可能是社會運動相互作用與爭鬥的場域:一方運動者提出法案,反制運動的另一方阻擋之、或提出相對的法案。再者,立法與訴訟當然可能相互關聯,例如法官造法、或者因憲法訴訟之結果而改變法律。因此,法律的規範世界無法外於運動的政治,而社會運動也不能無視於法體系的存在。
社會運動必須認真看待法律,而法律也必須認真看待社會運動。本課程探討法律與社會運動的關係,主題包括:法律動員做為社會運動策略、社會運動的法律構框、倡議法律人的角色、法律動員與社會變遷、保守法律運動。所將討論的難題包括:法律對社會運動有用嗎?倡議律師是否也代理自己?訴訟是權貴遊戲或弱者武器?是否可能贏了訴訟輸了大局、或可能輸了訴訟卻贏到未來?原意主義是否僅能作為保守法律運動的利器?我們也將在課程中思考,對作為單一制國家與大陸法系的台灣來說,要如何看待於普通法與聯邦制度背景下所得出的研究發現與研究議程?修課同學將藉由閱讀相關美國研究文獻來掌握基本概念與議題,透過上課報告與帶領討論學習表達與溝通,並以學期報告之寫作練習個案研究。

課程要求 |
1. 隱私政策:不得錄音、錄影,不得將上課影音或文字記錄公開於社群媒體、網路討論版或其他公開媒介。
2. 學倫政策:
(1) 不得使用ChatGPT或其他人工智慧語言程式協助撰寫提問與作業報告。
(2) 不得使用翻譯程式全篇或大量翻譯,以閱讀譯文取代文獻原文。
3. 電子設備政策:雖然筆電、手機、平版電腦等電子設備可以作為學習的工具,但更常構成個人與他人學習、教師教學的干擾。因此,上課時原則上禁止使用這些設備,除非(1)為了協助學習之用;(2)其他經授課教師允許的個案狀況。
4. 課程準備與參與:上課前應充分閱讀思考該週指定閱讀的文獻,課前於討論版提出反思問題,並於上課時積極參與討論。於本學期的課程中,每兩週至少提出一次課前的反思問題,繳交時間為每周日的晚上六點(旁聽生須繳交課前提問)。
5. 報告與討論:每位同學均應積極參與討論,並於學期中需負責至少一次報告,包括(1)摘要報告該週閱讀文獻的主要論點;(2)對該週主題與文獻的主要論點提出補充與評論;(3)探討閱讀文獻與臺灣的關係。報告部分以20分鐘為限。
6. 作業:
(1) 平時作業:繳交至少六次每週作業,回答指定之作業問題,以1500~2000字為度,得自行選定欲繳交之週次,於該週上課前一日(週日)中午12點之前繳交。注意事項如下:
A. 為使作業內容能確實反應閱讀思考之成果,請以指定閱讀文獻為討論對象,勿納入其他文獻之討論。
B. 除回答指定作業問題之外,作業內容得擴充延伸包含與之相關的其他討論,但仍以指定閱讀文獻之範圍為限。
(2) 期末小報告:選擇一個台灣個案為例探討法律與社會運動的關係,以4000~5000字為度,於5月21日前提交報告構想(欲研究的個案、將討論引用的周次主題與文獻),於6月18日前繳交。注意事項如下:
A. 報告內容應反映本學期學習之成果,並盡可能涵蓋各週主題的相關議題。
B. 參考文獻範圍以課程指定和參考閱讀為主,如引用非屬課堂指定參考閱讀範圍之文獻,至多三筆。
